US states move to block Trump's $100,000 H-1B visa fee

California and several other U.S. states are set to file a lawsuit on Friday seeking to block President Donald Trump’s proposed $100,000 fee on new H-1B visas for highly skilled foreign workers, according to the office of California Attorney General Rob Bonta.

The legal action will be at least the third challenge to the fee announced in September, which would sharply increase the cost of obtaining an H-1B visa. Employers currently pay between $2,000 and $5,000 in related fees.

Bonta’s office said the president does not have the authority to impose such a charge and argued that the move violates federal law, which limits immigration fees to amounts needed to cover the administrative costs of visa programs.

The H-1B program allows U.S. companies to hire foreign professionals in specialized fields, and it is heavily used by the technology sector. Many major tech firms are based in California and rely on the visa program to fill critical roles.
